Fixed Contract Consumer Broadband Service Terms

By signing up for or using Voyager Consumer Broadband Services under a Fixed Contract Term you agree to the terms set out below, which are specific to your Voyager Consumer Broadband service and apply in addition to the Standard Terms & Conditions and the Consumer Broadband Service Terms and Conditions. If there is any inconsistency between these terms and any other applicable Voyager Terms and Conditions and Policies, then these Specific terms shall prevail.

Other Voyager Terms and Conditions and Policies also apply to your use of our services. These are specifically referenced across these terms, the Consumer Broadband Service Terms and the Standard Terms and Conditions. Please note that as per clause 7 of the Standard Terms & Conditions, pricing is subject to change at any time during the term of this contract. We may also change these Service Terms in accordance with the process set out in clause 12 of the Standard Terms & Conditions.

 

1. Service Interruptions

We will use all reasonable endeavours to make our Services available to you at all times. However, our Services rely on us using networks and Services owned and maintained by third parties. We also reserve the right to temporarily suspend the Services or restrict access to our network for planned and unplanned maintenance or repair. For these reasons, we cannot promise that our Services will always be available or fully functioning. If our Services are unavailable for any reason, we will use reasonable endeavours to restore them as soon as possible.

2. Plan Changes and Move of Address

If your plan has a Fixed Contract Term and you request to upgrade your plan and/or move address during the fixed term period, you will remain subject to the terms of the applicable Fixed Contract Term contract. An upgrade is classified as a plan with a higher connection speed, or a technology upgrade from an ADSL or VDSL to a Fibre broadband plan.

As noted in clause 8 of the Consumer Broadband Terms and Conditions, we require some notice in advance to minimise the disruption for you.

If your plan has a fixed contract term and you decide to downgrade it within the term period, you will need to renew your contract for a new term to avoid Early Termination Charges (see clause 3). Note, if you are moving address to an area where we cannot offer the equivalent plan or higher, and therefore we are forced to downgrade your service (E.g. from a Fibre plan to a DSL plan), then you will not incur any early termination charges.

If your plan does not have a fixed contract term, or the contract term has lapsed, and you request a plan change or a move of address, you have the option of selecting from any available plan we offer.

3. Term and Termination

If your Plan has a Fixed Contract Term and you have agreed to use a Service for a Fixed Contract Term, then you must do so. If you cancel prior to the expiry of the applicable Fixed Contract Term, you will be liable for any applicable Early Termination Charges.

Once the Fixed Contract Term has expired, we will provide the relevant Services on a month by month basis until you elect to cancel or otherwise change your plan accordance with these terms and any other applicable Voyager terms and conditions or policies that also apply.

The early termination charge for Consumer Broadband 12-month fixed term is $199 including GST.

4. Personal information

You agree that we may collect, store, use and disclose personal information about you and the way in which you are using any applicable Voyager Consumer Broadband Services.

Please refer to Voyager’s Privacy Policy which explains the steps that we take to ensure full compliance with the Privacy Act 2020 when doing so.
